TASKS AND FUNCTIONS OF DEPARTMENT OF BIODIVERSITY CONSERVATION
 
The Director General of Vietnam Environment Administration signed the Decision No.1501/QD-TCMT on November 25th 2014 to define the functions, tasks, powers and organizational structure of the Department of Biodiversity Conservation which undertake the following task:
Article 1. Position and Functions
The Department of Biodiversity Conservation is an unit under the Vietnam Environment Administration (hereinafter called VEA), which implements functions of assisting the Director General of the VEA (hereinafter called Director General) in performing state management and managing law enforcement in conserving and utilizing sustainably biodiversity resources in the country – wide.
Article 2. Duties and Powers
1. To take the prime responsibility for or participate in formulating the draft laws, draft resolutions of the National Assembly, draft of ordinances, draft technical legal documents following the VEA’s annual programs and plans on establishing legal documents; to establish and submit the drafts of national policies, strategies, master plans, plans in the areas of nature conservation and biodiversity as assigned by the Director General;
2. To assist the Director General in guiding, inspecting and organizing the implemention of legal documents, strategies, master plans, plans, programs, themes, projects, standards, technical standards, criterias, procedures, technical economic norms for biodiversity after being approved or promulgated by the authorized agencies; to establish and submit to the authorized agencies promulgate the national criteria and statistical criteria system for biodiversity according to the state law.
3. To coordinate with Department of Planning and Finance in assisting the Director General to guide the ministries, branches and localities in utilizing the non-business expenditure source for environment, training, economy, science, investment in developing nature and biodiversity conservation.
4. To formulate the biodiversity conservation planning
a. To plan and submit to the General Director to get approval or submit to higher level of authority to approve for or adjust to the national biodiversity conservation planning, the technical instructional guides on its procedure on bio-diversity conservation at national, ministerial, and provincial level; documents to regulate and set the condition and standard for responsible units such as constructional units, consultant department for biodiversity conservation and other articles regarding to biodiversity conservation planning;
b. To assist the General Director in planning and establishing biodiversity corridors;
c. To assist the General Director in guiding, supporting the localities to formulate and adjust the biodiversity conservation at provinces and centrally-run cities;
d. To act as key agency in assisting the General Director in organizing, guiding, supervising the implementation of master plan on biodiversity conservation in nationwide; legal documents, strategies, plans, programs, schemes and other projects which related to the biodiversity conservation planning after being promulgated and approved;
e. To act as key agency in assisting the General Director in investigating, surveying, studying,  formulating the scientific and practical foundation to serve for the work of biodiversity conservation at national level and establishing biodiversity corridors.
f. To participate in appraising the biodiversity conservation plan at national, ministerial, provincial and centrally-run city levels.
5. To conserve and utilize sustainable ecosystems
a. To formulate, submit to the General Director or other level of authority to promulgate standards, technical regulations, procedures, technical economic norms on conservation and sustainable use of ecosystems and bio-diversity conservation zones and wetland areas.
b. To formulate and submit to authority to promulgate the criteria for classification, statistics and inventory in area of conservation zones and determine its location on land use maps or identify sea coordinates; to formulate the wetland classification systems, the criteria for classification of wetland conservation zones and rules of the conservation zones;
c. To assist the Director General in conserving and developing urban biodiversity conservation; to deploy activities to speed up green growth; to provide economic tools in conserving and developing of sustainable biodiversity; to assess the impact of climate change on biodiversity and to propose measures respond with climate change;  
d. To implement the basic survey programs and inventory, evaluate, monitor wetland areas; to formulate and guide the orders, procedures for establishing and appraising projects of establishing and converting wetland conservation areas; to establish and guide on formulating nomination to recognize ASEAN Heritage Parks and Ramsar Sites. 
e. To investigate and evaluate the economic value of ecosystems; to participate and direct the implementation of payment mechanism for ecosystem services; to do investation and to evaluate the ecosystems; to identify the ecosystems which are degraded in inter-provincial, transnational areas and propose, deploy the measures to conserve, remedy and utilize sustainable ecosystems; to formulate and guide the utilization of models of conserving and utilizing sustainably biodiversity at conservation areas and the models of wise use of wetlands;
f. To act as standing member in assisting the General Director to organize the interbranch committee to appraise projects for the national conservation area; to participate in the committees to appraise projects for establishing and converting national conservation area; to provide the guide for managing and developing wetland conservation areas, Ramsar sites, ASEAN Heritage Parks and also to manage the national conservation areas under the assignment;
6. To conserve and maintain sustainable development of species
a. To guide the investigation, monitor, and evaluation the existing of endangered, precious and rare species prioritized for protection; to list and file documents endangered, precious and rare species prioritized for protection; to grant the exploitation license for endangered precious and rare wild flora and fauna species prioritized for protection; to direct to transfer endangered, precious and rare species prioritized for protection to the conservation zones; to guide elaboration the scheme of establishing and grant license to formulating biodiversity conservation facilities according to the state law;
b. To establish regulations and guide to apply criteria for determining species which will be involved in the list of endangered, precious, and rare species prioritized for protection; to list endangered, precious, and rare species prioritized for protection; to provide order and procedures for appraising the dossier to suggest for taking in or taking out species in the list of being protected priority; to provide species on the list of endangered, precious and rare species prioritized for protection into biodiversity conservation facilities or for the lease thereof into their natural habitats; to guide the conditions of rearing,  planting, rescuing, releasing, storing, preserving  genetic resources and genetic specimens of endangered precious and rare species prioritized for protection; 
c. To assist the Director General in organizing, implementing conservation programs of wild fauna and flora species on the list of endangered, precious, and rare species prioritized for protection;
d. To formulate and submit to the competent authorities for promulgating periodically on mass media the list of endangered precious and rare species prioritized for protection and the list of invasive alien species; to formulate the database on endangered precious and rare species prioritized for protection and the list of invasive alien species;
e. To assist the Director General in organizing, investigating, filing, and listing invasive alien species; to direct the invasive risk analysis of alien species and propose the prevention methods and control of invasive alien species which have harmful to the environment and biodiversity; to establish and submit to the competent authorities for promulgating, guide, examine, supervise the implementation of plans, programs, schemes, projects for the prevention and control of invasive alien species;  
f. To assist the Director General in establishing and organizing evaluation committee to access the risk of alien species;
g. To assist the Director General in establishing the inter-branch consultant committee to appraise and submit to the competent authorities for approving the list of endangered, precious, and rare species prioritized for protection and the list of invasive alien species; to assist the Director General in establishing the appraisal committee to grant license for exploiting species in the list of endangered, precious and rare species prioritized for protection; to host and coordinate with related competent authorities at ministries, government levels and localities to compile a Vietnam’s Red Data Book;
h. To assist the Director General in organizing, guiding to conserve wild fauna and flora species in the list of being protected priority that are living in natural habitat where is not enough conditions to formulate conservation facility;
i. To deploy the models of conservation and sustainable use of wild endangered, precious and rare species prioritized for protection;
k. To assist the Director General in guiding, supervising the invasive alien species, conserving species at biodiversity conservation facilities and species in the list of endangered, precious, and rare species prioritized for protection, keeping genetic resources and specimens of endangered, precious, and rare species prioritized for protection;
7. To preserve and develop sustainable genetic resources 
a. To establish, guide regulations on management and supervision for the activities of accessing genetic resources and knowledge that related to its resources, sharing the benefits of accessing genetic resources that are under control of the State.
b. To establish and submit to the competent authorities for promulgating the regulations and to implement its regulations on controlling the biosafety on genetically modified organisms, specimens and products of genetically modified organisms; 
c. To assist the Director General in formulating and managing uniform national database on genetic resources, traditional knowledge of genetic resources, genetically modified organisms, genetic specimens of genetically modified organisms which are related to biodiversity;
d. To assist the Director General in examining, supervising the units that grant license to access the genetically resources as of its competence; to examine inter-branch and irregularly the implementation of risk management measures for genetically modified organisms;
e. To submit member of the expert group to the Director General and assist the Director General in implementing function of assisting the MoNRE Leadership’s in formulating the Biosafety Council to appraise, evaluate the dossier of registration for biosafety certification; to synthesize, collect and report to the competent authorities to make decision for granting or denying, revoking the Biosafety Certification on gene transfer technology; to host in receiving the dossier of registration for biosafety certification and organize the meetings, coordinate the activities of the Biosafety Council and the group expert;    
g. To investigate, collect, evaluate and formulate the database on genetic resources which is prioritized protection by the state and the traditional knowledge of genetic resources; to formulate the genetic resources conservation, access and benefit sharing models;
h. To investigate, evaluate the commercialization and release of genetically modified organisms into the environment and propose its control measures;
8. To deploy the applied research, technical progress and technology transfer on biodiversity conservation under the allocation of the Director General;
9. To implement the basic survey on biodiversity; to formulate the criteria, parameters and guidance on monitoring biodiversity; to establish and guide the implementation of master plans, plans, schemes on biodiversity;
10. To assist the Director General in formulating and managing uniform database and information exchange mechanism on biodiversity; to act as key agency in providing official information on biosafety to countries, territories and international organizations according to the provisions of the state law; to elaborate the national biodiversity report;
11. To act as standing member of the Branch Steering Committee in implementing national strategic on biodiversity, biosafety and issues related to biodiversity conservation;
12. To participate in propagating, distributing, educating on legislation, training, cultivating professional skills and expertise on nature reserve and biodiversity according to its competence; to organzie activities in response to the World Biodiversity Day and the World Wetlands Day;
13. To coordinate with related agencies to formulate and submit the programs, international cooperation projects on biodiversity to competent authorities; to act as the key agency in implementing the Convention on Biological Diversity, the Ramsar Convention on wetlands of international importance, The Nagoya – Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety, The Nagoya Protocol on access to genetic resources and the Fair and Equitable Sharing of Benefits, The Asean Centre for Biodiversity and other international treaties under the allocation of the Director General; to get involved in international treaties or agreements, international organizations on nature reserve and biodiversity conservation according to the provisions of the state law;
14. To get involve in inspecting and supervising the compliance with environmental protection regulations at the nationwide scope;
15. To implement the administrative reform along with the programs, plans of the VEA’s administrative reform and according to the allocation of the Director General;
16. To manage Department’s finance and its properties; to act as a role of the level III units under the VEA according to the provisions of the state law;
17. To have clear policy on employee’s benefits, and its contract according to the state law;
18. To synthesize, submit periodic reports and irregular reports on implementing duties which have been allocated under its function;
19. To implement other duties as assigned by the Director General;
